Les articles 72 à 85 de la loi susmentionnée accordent aux prisonniers, y compris lorsqu’ils sont mineurs, le droit d’accès à une mosquée ou à un autre lieu dans lequel ils peuvent faire leur prière, d’assister à des conférences religieuses et participer à des groupes de discussion sur la religion.

2. It is provided for in the Section 152 (4) of the Criminal Procedure Law that in cases if a psychologist indicates to a person directing the proceedings that the psyche of an underage person or of a minor who has been recognised as a victim of violence committed by a person upon whom the victim is materially dependent or otherwise dependent, or a victim of sexual abuse, may be harmed by repeated direct interrogation, such direct interrogation shall be performed only with the permission of the investigating judge, but in a court – with a court decision.

L’article 152 (par. 4) du Code de procédure pénale prévoit que si un psychologue indique à la personne dirigeant la procédure qu’un interrogatoire direct et répété peut nuire à l’équilibre mental d’un mineur, d’un mineur reconnu comme victime d’agressions sexuelles ou d’un mineur victime de violences exercées par une personne dont il est dépendant matériellement ou à d’autres égards, l’interrogatoire n’aura lieu qu’avec l’autorisation du juge d’instruction et dans un tribunal qui aura statué en ce sens.

3. In order to facilitate and help such transformation, the following conditions will need to be filled in: —keeping clear of hiding Palliative Care by reducing and bounding only to its oncological approach; —taking into account not only the disease itself, but the whole needs of the patients and of their families; —providing an efficient coordination between all professional bodies and mainly, Palliative Care professionals, Algologists, Psychologists, Social workers...; —to implement the patient himself and his family, “pluridisciplinarity” and continuous care. It must be emphasized that such a new term like “Supportive Care” would induced involuntarily confusing ideas of policy and provision.

Pour que ce changement soit réel, certaines conditions devront impérativement être remplies: éviter d’occulter les soins palliatifs, de les enfermer et de les limiter au champ de la cancérologie; prendre en compte les besoins des patients et de leurs proches; créer une véritable coordination entre cancérologues, acteurs de soins palliatifs et d’accompagnement, algologues, psychologues...; veiller à la réalité sur le terrain de la pluridisciplinarité et de la continuité des soins.
